beneficial, agreeable and fair to both buyers and sellers, BidWerX.com Online
Auctions has established policies and disclaimers hereby known as its User
Agreement.
This User Agreement describes the terms and conditions
applicable for you to use services offered at BidWerX.com. BidWerX.com,
like other online auctions is built solely on trust, and accepting this User Agreement
helps ensure the trust between registered users who elect to use this site. If you do not
accept these policies and disclaimers you may visit the site anytime as a non -

BidWerX.com, herein referred
to as "BidWerX.com Online Auctions" or "site", has
been established to provide listing services to its registered users as set forth in the
outline below. This outline is the official policies and disclaimers of BidWerX.com
Online Auctions, and by registering all participants have agreed to abide by this
User Agreement as it is presented. This User Agreement is subject to amended terms without
prior notice as deemed necessary by BidWerX.com Online Auctions
administration. The amended terms adhere to accepted practices as applied to or developed
in conjunction with the operation of this site and become effective 30 days after they are
posted on this site.

BidWerX.com site is an online listing
agent providing services for both sellers and buyers using seller classified items in
Categories A thru Z and items in Auction Shops. Sellers are those who list items for the online auctions, while
buyers are those that bid on those items for potential purchase. These services for
registered sellers and buyers are provided as follows:
For Sellers:
- Provide a posted/listed means for presenting items for sale
- Provide the necessary methods for conducting the auction
selling process
- Provide the necessary methods for following-up on and
maintaining items placed in the auctions
For Buyers:
- Provides a means to purchase items for sale by auction
- Provide the necessary methods for following-up with the
auctions participated in

Registration is required at BidWerX.com Online
Auctions in order to participate. Registration by all participants indicate
agreement to abide by User Agreement as it is presented. All information is kept
confidential (except for e-mail addresses, which are part of the online auction process).

The purposes for registration are as follows:
- Provide "real-person" contact information between BidWerX.com
administration and seller/buyer should the need arise
- Assure to some degree the sincerity of participants
- Simplify participation in the auction process
- Receive benefits that may be offered by BidWerX.com
Registration information will not be used for marketing or solicitation by BidWerX.com
or third parties. Registration is subject to verification of the information provided by
the registering user when deemed necessary by BidWerX.com administration.

Only registered users with billing accounts may sell items on the online
auctions. All items presented are the sole responsibility of the seller. BidWerX.com
Online Auctions is a listing service for items being sold by the means of
interactive electronic listings and does not hold nor is responsible for any merchandise
presented by the seller.
Placing items in the auction
Registered users may place an item in the online auctions
by using the forms provided in the Registered User Services page. Sellers must specify
such options as category, price, description, starting date/time and length of desired
online auction for each item. Do not state that users may wait out the bid on an item
while the online auctions are active and that if the item does not sell successfully,
purchase the item outside of BidWerX.com. Users repeatedly using these
tactics, are subject to deactivation of their account and could result in legal action by
the parties involved.
Removing items from the auction
Sellers may remove items from the online auctions before
their specified closing date and time only if the online auction has not received at least
one bid. If an auction has received at least one bid and the seller wishes to remove it,
they may do so by only closing it early. The auction will be considered sold and is
subject to the appropriate commissions based on the highest bid received.
Rights of the seller :
As a registered user, sellers have the right to list
quality items for sale in the online auctions. BidWerX.com reserves the
right to refuse any item for any reason. Although the seller cannot be forced to actually
sell items to winning bidders in the online auctions, failure to do so is not in keeping
with the policies agreed to and its continued practice is grounds for the loss of all
rights to participate at BidWerX.com. If up to three legitimate
complaints are filed in writing regarding a sellers transactions, they will be barred from
the site. Complaints are addressed in writing to our company office, not via e-mail. BidWerX.com
reserves the right to revoke (block) the privilege of participation for any reason. Please
also note that the basic definition of a contract is an agreement between two or more
parties, i.e. seller and bidder, which could be considered binding by many states and
failure to comply could result in legal action between the buyer and seller.
Selling Guidelines :
Sellers should:
- Represent items correctly and ethically that they offer for
sale
- Answer valid inquiries about items for sale by potential
bidders
- Sell the items presented to winning bidders
- Respond to the winning bidders in a timely manner (including
sending merchandise after payment is secured)
- Keep in mind that you are committing to selling these items
at BidWerX.com as you would be in any Auction.
- Refusing to sell these items to the winning bidder
at the end of your auction, may very well cause you to permanently lose the right to
participate at BidWerX.com auctions.
Sellers should not:
- Bid on their own items
- Select who they wish to sell the item to, regardless of the
winning bidders
- Sell a submitted item outside of BidWerX.com
while concurrently having your auction active at BidWerX.com
- Have an item submitted at BidWerX.com and
concurrently have the same item submitted at another auction
- Refuse a legitimate claim by winning bidders of the items
presented

Only the registered user (one id per person and no sharing
of the id, no exceptions) may bid on items presented in the auction. All items presented
are the sole responsibility of the seller. BidWerX.com is merely the
listing service, and does not hold nor is responsible for any merchandise presented in the
auction listings. This service is a technological interactive version of newspaper
classified ads, and the auction formats are modeled after "real life" auctions.
Placing bids
Registered users may place a bid for an item each time they
view an auction. You may bid as often as you like on any item. The bid amount shown is the
next bid allotted for this item. The system allows you to first preview your bid and then
submit the bid. To save yourself time, pick the maximum bid right from the beginning and
let the system confidentially place bids for you.
Placing a bid is a binding contract. Once you submit a bid,
you may not retract a bid.
Rights of the bidder :
As a registered user, bidders have the right to submit
valid bids on items for sale in the auction. Although the buyer cannot be forced to
purchase items successfully bid on, note that failure to do so is not in keeping with the
policies agreed to and its continued practice is grounds for the loss of all rights to
participate at the site. If justified complaints are filed against a bidder, they will be
barred from the site. Complaints about sellers transactions are addressed in writing to
our company office, not via e-mail and only after you have followed through the procedure
of contacting another user. BidWerX.com Online Auctions reserves the
right to revoke (block) the privilege of participation for any reason. Please also note
that in many states by basic definition of a contract, a bid is considered binding and
failure to comply could result in legal action between the buyer and seller.
Bidding guidelines :
Bidders should:
- Bid only on items they are willing to purchase
- Bid only the amount(s) they are willing to pay for an item
- Purchase items successfully bid for
- Respond to the sellers within 24 hours and have payment to
the seller within 5 business days
- Keep in mind that you are committing to purchase item(s) at BidWerX.com
when you place a bid, as you would be in any Auction.
- Refusing to purchase item(s), if you are the winning
bidder, may very well cause you to permanently lose the right to participate at
BidWerX.com online auctions.
Bidders should not:
- Bid on items they do not wish to purchase
- Bid amount(s) they are not willing to pay
- Ask the seller what the reserve is
- Refuse to purchase items for which they have successfully
bid
- Contact the seller to purchase the item(s) outside of BidWerX.com

Limits of BidWerX.com
Users agree through registration that BidWerX.com
is not responsible for nor can be held liable for merchandise presented in the auction
listings. All merchandise is the sole responsibility of the presenting seller and BidWerX.com
cannot make any warranty, expressed or implied, as to the condition or the functionality
of items offered for sale. BidWerX.com cannot be held liable for any
damages incurred as the result of participation in this site or resulting transactions
from this listing service.
BidWerX.com cannot be held responsible for
incomplete transactions resulting from a refusal to buy or sell by its participants.
Buyers and sellers assume full responsibility for completing any transactions begun at the
site. BidWerX.com is a listing service and will play no role in
collecting any monies or have any involvement in concluding sales or disputes between
buyers and sellers for the items presented.
Disputes
Should a dispute arise, BidWerX.com will
not act as mediator between the involved parties. Resolution of disputes is the full
responsibility of the involved parties. After all, you wouldn't be contacting the
newspaper classifieds to resolve an issue for you. Should it become necessary, you may
receive contact information of the said parties from the database at BidWerX.com
if justified. Abuse of this information will not be tolerated.
Limits to sellers
BidWerX.com cannot be held accountable for
any action or non-action of the buyers nor a refusal to follow through to purchase item(s)
or returning item(s). It is the responsibility of sellers to collect any monies for sold
items from the winning bidder.
Limits to bidders
BidWerX.com cannot be held accountable for
any actions of the seller nor the refusal to sell or deliver the merchandise. It is the
responsibility of the winning bidder to resolve such disputes with seller. BidWerX.com
is not responsible nor can be held liable for the merchandise presented by its users with
this listing service.

As a registered user, sellers have the right to submit
valid items on this site except those subjects listed below. BidWerX.com Online Auctions reserves the
right to revoke (block) the privilege of participation for any reason. Complaints about Illegal, Infringing and Questionable Items
as those listed below will be handled administratively with items becomming inactive and deleted from this web site.
